Workers Compensation

Your employees are the backbone of your organization, and we are here to help ensure safety in the workplace and provide them with the care they need if a workplace injury occurs. If any of your employees sustain a workplace injury, we are proven leaders in ensuring they receive the necessary care so they can get back to work quickly. Through Berkshire Hathaway Homestate Companies (BHHC), Berkshire United offers a wide range of Workers Compensations facilities, providing personalized attention to injured workers and impactful services to policyholders and agents.

What Does Workers Compensation Insurance Cover?

Workers Compensation insurance is required by law in most states. If your business does not have it, you may face state fines, penalties, and even imprisonment. You could also get saddled with unanticipated costs making your business less competitive. Additionally, most states require companies to provide Workers Compensation for independent contractors and subcontractors who don’t have coverage. Workers Compensation claims can last for decades. A poor short-term decision on a carrier can cost your business a lot in the long term.

Specific coverages provided are as follows:

  • Workplace Injuries: In the event an employee becomes ill or is injured while performing their job duties, Workers Compensation helps cover them for related medical care and economic losses. Most importantly – our team is focused on getting that employee back to work as a contributing member of your team.
  • Disability: If a team member becomes severely injured on the job, a Workers Compensation policy covers wage replacement, ensuring the employee can focus on recovery and rehabilitation.
  • Death Benefits: If someone dies in a work-related incident, death benefits may be available to their family depending on the work location of the employee. These benefits offer financial support when an employee’s family needs it the most.
  • Employers Liability: Employers Liability Insurance covers additional damages that may be caused by employer negligence. Types of Employers Liability claims include:
    • Third-Party Action: If an injured worker sues a third party that they believe to be responsible for the injuries, and the third party files a lawsuit against you, the Employers Liability limits coverage will apply.
    • Loss of Consortium: The immediate family of an injured worker sues the employer for injuries resulting in the loss of a family relationship such as companionship, help with household duties, and other hardships.
    • Dual-Capacity Suit: An injured worker sues the employer based on a secondary relationship the employer shares with the employee, whether as a supplier of a product, provider of a service, or owner of a premise.
    • Consequential body injury: The immediate family of an injured worker sues the employer because, as a result of the injury sustained by the worker, the immediate family members also suffered injuries.

Commercial Auto

Commercial vehicles require specialized insurance policies due to the unique risk associated with a business that does not exist with a personal auto policy. Just because your business is not in the transportation industry does not mean Commercial Auto coverage is not necessary. As an example, you likely need commercial auto if your employees run errands, carry tools, or transport clients in any vehicle. Selecting commercial auto insurance coverage that meets your specific needs is vital to protecting your business and income. The Berkshire United Commercial Auto policies provide several protections, including Auto liability coverage that can help pay for property damage or bodily injury you or your employees cause. The Berkshire United Commercial Auto products are underwritten and serviced by Berkshire Hathaway Specialty Insurance.

What Does Commercial Auto Insurance Cover?

  • Property Damage Liability Coverage: If your vehicle accidentally causes damage to another person’s vehicle, this coverage can protect you.
  • Medical Payments, No-Fault, or Personal Injury Coverage: This coverage provides payment for any medical expenses that may arise due to an employee or a passenger traveling in your vehicle, regardless of who is at fault in an accident.
  • Uninsured Motorist Coverage: This coverage provides payment for any medical expenses, or in some cases, property damage caused by a hit-and-run driver or an uninsured driver. Underinsured motorist coverage may also be included depending on the type of policy.
  • Comprehensive Physical Damage Coverage: This coverage addresses damage resulting from theft, vandalism, flood, fire, and other specified hazards.
  • Collision Coverage: This coverage provides payment for damage resulting from being hit by or hitting another object.

  • Bodily Injury Liability Coverage: This coverage provides payment in cases of bodily injury or death resulting from an accident for which you are at fault.
  • Combined Single Limit: Liability policies provide different maximum dollar amounts that the insurer will pay for various components of a claim. A combined single limit policy states that the insurer will pay up to a certain dollar amount for the entire claim. It doesn’t matter whether all components of the claim are related to one person’s injuries, or whether there are multiple injured parties represented by the claim.
